Terms

1. These terms & conditions shall apply to all work assigned to the civil partnership Wenckebach Bax & Brunt Advocaten. The civil partnership consists of the limited liability company Wenckebach Advocatuur BV, Bax Advocatuur BV and Poppiano B.V. These terms are also stipulated for the benefit of these limited liability companies and its directors, shareholders and staff. All work is deemed to be assigned to and accepted by the partnership Wenckebach Bax & Brunt Advocaten only.

2. Any liability on the part of the partnership Wenckebach,Bax & Brunt Advocaten shall be limited to the amount that is, in each particular case, actually covered by and paid out under the professional liability insurance policy of the partnership Wenckebach Bax & Brunt Advocaten. Any liability on the part of the directors, shareholders and/or staff of Wenckebach Advocatuur BV, Bax Advocatuur BV Poppiano B.V. is excluded.

3. All due care will be exercised in the instruction of third parties, such as bailiffs, local counsel (procureurs) en expert witnesses, and selection of those third parties will, to the extent required only take place in close consultation with the client. Any liability for faults or omissions on the part of those third parties is excluded. If third parties use terms & conditions, the partnership Wenckebach Bax & Brunt Advocaten is authorised by the client to accept these conditions and the partnership Wenckebach Bax & Brunt may rely on such terms vis-à-vis the client.

4. Applicability of articles 7:404. 7:407 lid 2 and 7:409 Dutch Civil Code, is excluded. Directors, shareholders and staff of the partnership Wenckebach Bax & Brunt Advocaten or its limited liability partners, are not personally bound by or liable for the work assigned, even if that work was assigned to a particular individual.

5. All services are rendered solely and exclusively for the benefit of the client and third parties cannot rely on or invoke rights in relation to (the results of) any work carried out.

6. These terms & conditions apply to any subsequent, amended or additional instructions of the client.

7. The relationship between  the partnership Wenckebach Bax & Brunt Advocaten and the client is governed by Dutch Law. Any and all disputes shall be exclusively submitted to the competent court in Haarlem (the Netherlands).
